If you are a UAS operator registered in an EU member state outside Austria and intend to conduct a UAS flight within the "Specific" category (Article 5 of Regulation (EU) 2019/947) that takes place partially or entirely in Austria, you must obtain an authorization under Article 13 of Regulation (EU) 2019/947:
 
To proceed, first contact your national aviation authority to submit the required declaration (for STS) or obtain an operational authorization. Once you have received the necessary documents, you can apply for a cross-border operation in Austria under Article 13 VO (EU) 2019/947
 
Ways to Apply for an Operational Authorization Under Article 13 of Regulation (EU) 2019/947:
 
 
 
 
Case 1: Cross-Border Operations Covered by an STS Declaration:
 
1. Submit your STS declaration to the aviation authority of your registration state. If the declaration complies with Regulation (EU) 2019/947 and Regulation (EU) 2019/945, you will receive confirmation of receipt and completeness.
2. Send a copy of your operational declaration and confirmation of receipt/completeness from your national aviation authority to .
3. Once Austro Control confirms receipt of your documentation, you may begin the operation in accordance with the Standard Scenario requirements.

Case 2: Cross-Border Flights Not Covered by an STS Declaration:
 
1. Obtain an operational authorization from the aviation authority of your registration state.
 
2. When applying for a cross-border flight in Austria, submit the following documents to Austro Control:
 
  • Completed and signed application form
  • Copy of the operational authorization issued by the aviation authority of the registration state
  • Updated risk mitigation measures considering the specifics of the operational area
  • Proof of compliance with local conditions
3. Austro Control will review the submitted documents, including the proposed updated risk mitigation measures. If the assessment is successful, a confirmation for the cross-border flight will be issued and sent to you via email.

Case 3: Cross-Border Operations by Operators with an LUC:
 
If you hold a Light UAS Operator Certificate (LUC) issued by the aviation authority of your registration state, granting you the authority to self-authorize flights within the approved operational conditions, you must submit the following documents to Austro Control:
 
  • Completed and signed application form 
  • Copy of the LUC approval conditions
  • Location(s) of the intended operation
  • Updated risk mitigation measures considering the specifics of the operational area
  • Proof of compliance with local conditions

If the LUC approval conditions grant the authority to assess local conditions and apply risk mitigation measures at other locations, the UAS operator may begin the flight as soon as Austro Control confirms receipt and completeness of the application. A confirmation of receipt will be provided.
 
In cases where the LUC approval conditions do not include the authority to assess local conditions and/or apply risk mitigation measures at other locations, the UAS operator must wait until Austro Control confirms the acceptability of the updated risk mitigation measures and procedures for the intended locations before starting the flight.
 
For an Article 13 application for Austro Control, the following fees should be considered in accordance with the Austro Control Fees and Charges Regulation (ACGV - Austro Control Gebühren Verordnung):
  • Application Fee (TP 59h: 109 €),
  • Official Act (Review of the Application (TP92: 92 € per 1/2 hour) and
  • tax (20% applicable to the total of the fees listed above).
